Cost-of-Living Adjustment (COLA)
Cost-of-Living Adjustment (COLA)Cost-of-Living Adjustment (COLA)A cost-of-living adjustment (COLA) is an increase in salary or annuity usually based on an objective measure that estimates how much additional money a typical person or household needs to maintain their standard of living. Inflation acts against the buying power of every dollar. The prices for goods and services increase over time, so a stable income devalues over time. A COLA works against inflation to maintain the salary or annuitys buying power. Not Merit-Based Raises They are almost always applied across an organization or population of annuitants. Notable exceptions would be companies with workers spread across the US or the world. In those cases, a company would consider COLAs that vary by geographic region. They that are not based on an objective measure are doomed either to be inadequate to maintain buying power or to be unnecessarily high therefore, it would be somewhat of a misnomer to call those raises CO LAs. The most common objective measure used to determine the amount of a COLA is the consumer price index for urban wage earners and clerical workers (CPI-W). The US Social Security Administration is required by law to use the CPI-W to calculate their annual COLAs to their annuitants. The CPI-W is calculated by the US Bureau of Labor Statistics. US Government COLAs COLAs for federal workers must be authorized by law. COLAs for civilian employees and military employees are considered separately by Congress. When one of behauptung two groups receives a COLA, the other group immediately begins lobbying Congress to provide the same COLA for them. At times the COLAs are not the same for both groups, and this can lead to widespread employee dissatisfaction. COLAs may also be given to federal retirees under the Federal Employees Retirement System or Civil Service Retirement System. Private Sector Businesses in the US are not required to provide their workers with COLAs however, man y do. Employment market forces work quickly against employers who do not maintain their employees salaries. Sometimes union contracts have cost of living adjustments built into them. Union leaders push for absolute numbers in negotiations, so they have guaranteed wage increases. While management has an incentive to know precisely how much money will be paid in wages each year, a COLA based on objective criteria ensures that management will not overpay for automatic wage increases.

The key to talent acquisition Job training programs for hidden talent
The key to talent acquisition Job training programs for hidden talentThe key to talent acquisition Job training programs for hidden talentWith the tightest labor market the United States has seen in 50 years, and the average cost inflicted on employers for long-term job vacancies at more than $800,000 a year, HR departments are jostling for qualified candidates to meet labor requirements. But a persistent skills gap and an unemployment rate hovering near 3% is hitting businesses large and small.Job openings have outnumbered Americans seeking work for the 13th straight month there are 1.28 million more available jobs than unemployed people. Employers looking to fill open roles are in a bind. To fill vacancies maiming productivity, they need to find training programs that divert from traditional hiring pools. These are three key aspects to look for when choosing a new talent acquisition program for your company.Jump into new hiring poolsIf your company is struggling to fill vacancies , it is time to shake up where you are looking for talent. Look beyond individuals from top colleges or those who fit the exact level of experience and education level you typically adhere to. In fact, many successful companies, like Apple and Google, no longer require employees to have college degrees at all. Journey towards individuals who arent a cookie-cutter fit or are otherwise overlooked, such as opportunity youth, military veterans, and their spouses. Find employees from the communities where your business has a presence.I founded a nonprofit, Workforce Opportunity Services (WOS), to help Corporate America find this hidden talent. Through partnerships with organizations seeking to diversify their workforce, WOS develops and nurture the skills of talent from underserved communities. The idea came from a student who took my tech management course at Columbia University. We started a program helping individuals in Harlem, where almost a third of households had incomes below the federal poverty level, find and maintain jobs. It was free, and we were successful in finding people leid just jobs, but careers. Research showed that the talent was there, they just needed the training, mentorship, and support, as well as self-confidence, to secure and hold onto their jobs.Clear the path to successReceiving more than just technical (hard-skills) training is imperative to success when comparing talent acquisition alternatives. Does the program remove barriers and clear the path to success for future employees? Those who go through the WOS program receive training in professionalism, business communications, and interpersonal skills. Employees need both hard and soft skills to succeed. They also receive health insurance and stipends as a part of the program. To invest in long-term success, our candidates must have their short-term financial needs met. To address this gap, WOS sometimes goes further to bridge the gaps of the economic divide. Weve paid for WiFi so can didates can complete training courses at home, childcare to ensure the individual can make it to work or class, transportation stipends and college tuition, enabling individuals to get their bachelor degrees. The cost of higher education has skyrocketed 213% in the past 30 years it has become so cost prohibitive that its a luxury most simply cannot afford. Americans with a bachelors degree earned less in real terms than in 1990, diminishing its perceived value. Pivot once again and go back to basics. Utilize workforce development organizations that pair potential employees with one-off courses or boot camps specific to a skill set. In seeking talent to fill vacant IT positions, power company PSEG enlisted WOS expertise to find and develop talent from underserved communities in New York City. The corporation and nonprofit are partnering with General Assembly to provide coding instruction, a $15,000 value per person, free of cost to nine individuals taking the course. Mohammad Khan, a 23-year-old from the Bronx, graduated from a high school with just an 18 percent graduation rate. He is now being trained to be an IT specialist for PSEG. Another participant, 24-year-old Amro Manaa, said his greatest barrier of entry to working in tech was the cost associated with learning to code.Absorb the riskCorporations are starved for good talent but they are resistant to risk. Every time a business replaces a salaried employee, it costs 6 to 9 months salary on average to replace them. They are hesitant to pour resources into a new employee they are unsure to be cut out for a corporate environment. That risk aversion to hiring out of the ordinary pool could be to the companys peril.A third-party training provider needs to first transform the talent to meet the needs of a potential employer and then absorb all of the risks of hiring a new employee, which can be accomplished by providing a trial period for each potential new hire. For the initial six to 12 months, the company i tself does not employ the employee, rather the training organization is the official employer. The training provider administers the benefits, i.e. health insurance, additional professional development opportunities, and organizes a case manager to alleviate any HR situations and provide mentorship support. At the end of the trial period, the corporation can choose to hire the candidate as a full-time employee.Hewlett-Packard (HP), one of the leading global software companies, started its partnership with WOS to recruit and train veterans for vacant IT roles. Upon the programs completion, all participants, including the attrition reserve, were hired on full-time, with a 100 percent retention rate by the end of the first year. This program saved the software company $150,000 in new hire expenses.Dr. Langer is the director of the Center for Technology Management at Columbia University and founder of Workforce Opportunity Services, a nonprofit committed to developing the skills of unta pped talent from underserved and veteran communities through partnerships with organizations dedicated to diversifying their workforce. Spark a Conversation Video Interviewing During the Holidays - Spark Hire
Spark a Conversation Video Interviewing During the Holidays - Spark HireHere at Spark Hire, we want to help companies utilize the power of zugreifbar video to find the best candidates. We get a lot of questions from readers about best practices for using online video in the hiring process. These posts will address those questions about how to find your next superstar employee.Question What are some ways to use video interviewing this holiday season? -Sandra from Peoria Thank you for your question, Sandra. The holiday season is a particularly rough time for hiring since it is usually such a busy time. Many people go on vacation with their families or take time off in order to spend quality time with their families over the holidays. On top of that, for some companies the end of the year is the busiest and most hectic time of the year. Packed calendars are the norm and it can be very difficult to find the time to interview with job seekers that are semi-available. Plus, when some of yo ur coworkers are out of the office, it can be increasingly difficult to collaborate on a new hire.Thankfully, video interviews can lighten the load a bit and make interview scheduling much easier. When you decide to use video interviews as part of your screening and hiring process, the dilemma of finding the right time to meet with busy candidates is eased. With video interviews, job seekers never have to leave their home to meet with you. This is especially important during the busy holiday season and during the winter when weather may prevent top candidates from making it to your office. Instead of having candidates come into the office for a series of interviews, you can instead conduct the first interviews online through video interviews on Spark Hire. Then, once you have whittled the list of qualified candidates down to a few, they can come into the office for a final, in-person interview.By then you should have a wealth of information gathered on the candidates from your video interviews. You can learn whatever else you need to make a decision in the final meeting. This opens up scheduling and makes the hiring process during the holidays much easier. Furthermore, when you use one-way video interviews you dont even have to worry about scheduling conflicts. Rather than trying to find ample time to speak with candidates over the phone, you can send them a one-way video interview request. With one-way video interviews, you send candidates a series of questions you would likely ask in a phone interview. You set a deadline and the candidates have until then to record their answers to your questions with video. You wont have to worry about finding time in your schedule or theirs to connect and screen. Once you receive their answers, you can review them when you have the time. The best part is you can complete 10 one-way video interviews in the same time it takes to complete one phone interview (30 minutes). So if scheduling and time is a problem for you over the holidays, hire the smart way and start using video interviews in your hiring process. Happy HolidaysDo you have a question you need answered? Spark a conversation with the Spark Hire team by submitting your question to blog(at)sparkhire.com or in the comments below.

This is why the holidays make us feel terrible sometimes
This is why the holidays make us feel terrible sometimesThis is why the holidays make us feel terrible sometimesFor some of us, tis not the season to be jolly. Although the holidays can be a festive time of togetherness and family, for those of us who are lonely, the holidays can be an unhappy and isolating reminder of the community we want but do not have.In one study, people reported feeling less satisfied with life during the holiday season. In fact, one review of holiday health studies found that there can be a negative Christmas effect on our minds, where theres an uptick in loneliness, depression, and anxiety reported by patients around the Christmas holiday.P.O. Peretti, one of the researchers cited in this review, concluded that Christmas depression in his 420 participants was tied to the individuals belief in the myth that everyone else is having a good time and engaged in loving family relationships - clearly a wish, but not necessarily a fact. This loneliness can have serio us consequences for employees returning from holiday. One Harvard Business School analysis found that when we feel less socially connected, we are more likely to feel burnt out and exhausted at work. How to combat holiday lonelinessTo combat this social isolation, its important to first stop comparing your holiday experience to others. Dont presume to think that your co-workers are having a joyous holiday even if their social media posts only show happy faces. If you are dealing with the loss of a loved one this holiday, dont put pressure on yourself to be happy, grief therapists advise. That pressure will backfire and make you feel even more unhappy. As clinical psychologist Andrea Bonior put it, Give yourself permission to not have to be as jolly as everybody says you have to be, she said. Say to yourself, Some days this season might not be great and thats okay. I dont have to force holiday spirit.Once you embrace this mindset, you can start to actually enjoy your holiday on your te rms. Try new experiences like watching a movie or volunteering to create a new routine and help you feel less stuck.Recognize that loneliness makes us underestimate how much the people around us actually care about us. It tells us stories about ourselves that arent necessarily true. It makes us isolate ourselves further. Louisa Sylvia, associate director of psychology at Massachusetts General Hospital Bipolar Clinic and Research Program, recommends overcoming that isolating impulse by reaching out to your chosen people.Reach out to the people who are your support, she told CBS News. I think people tend to feel like they cant do that because its the holiday season and they dont want to burden friends, but this is exactly the time to reach out to people and lean on your support system because it is a difficult time.

How the Civil Rights Act of 1964 Factors into Employment Practices
How the Civil Rights Act of 1964 Factors into Employment Practices How the Civil Rights Act of 1964 Factors into Employment Practices The Civil Rights Act of 1964 (Public Law 88-352) outlawed the unequal application of voter registration requirements and discrimination in public facilities, in government, and in employment. Specifically, for employers, in the Civil Rights Act, Title 7 guaranteed equal opportunity in employment. Additional titles within the Civil Rights Act ensured the right to vote, provided relief against discrimination, authorized the Attorney General to institute suits to protect constitutional rights in public facilities and public education, and more. The Civil Rights Act in Promoting Equal Employment Opportunity The Civil Rights Act also established the Equal Employment Opportunities Commission (EEOC) to promote equal opportunity in employment through administrative and judicial enforcement of the federal civil rights laws and through education and technical assistance. Subsequent legislation expanded the role of the EEOC. Today, according to the U. S. Government Manual of 1998-99, the EEOC enforces laws that prohibit discrimination based on race, color, religion, sex, national origin, disability, or age in hiring, promoting, firing, setting wages, testing, training, apprenticeship, and all other terms and conditions of employment. Race, color, sex, creed, and age are now protected classes. As long as an employer makes no employment decisions namely, whether to interview, hire, pay, promote, provide opportunity, discipline, or terminate an employees employment based on any of these protected classifications, the employer is living the intent of this law. Preventing Discrimination With the Civil Rights Act It is, however, easy for unconscious discrimination to affect any of these decisions. The Human Resources department plays a significant role in guarding and overseeing to make sure employment decisions do not violate the spirit of this law. When hiring, for example, HR can share an applicants resume and cover letter. The job application, which may reveal a number of these protected factors, should remain confidential to HR. Details of the Civil Rights Act Through Laws and Guidance Laws and guidance in detail from the EEOC are available from the US Department of Labor: Laws and Guidance. The specific text of a relevant portion of the act for your review: DISCRIMINATION BECAUSE OF RACE, COLOR, RELIGION, SEX, OR NATIONAL ORIGIN SEC. 703. (a) It shall be an unlawful employment practice for an employer (1) to fail or refuse to hire or to discharge any individual, or otherwise to discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such individuals race, color, religion, sex, or national origin; or (2) to limit, segregate, or classify his employees in any way which would deprive or tend to deprive any individual of employment opportunities or otherwise adversely affect his status as an employee, because of such individuals race, color, religion, sex, or national origin. (b) It shall be an unlawful employment practice for an employment agency to fail or refuse to refer for employment, or otherwise to discriminate against, any individual because of his race, color, religion, sex, or national origin, or to classify or refer for employment any individual on the basis of his race, color, religion, sex, or national origin. Equal employment opportunity (EEO) laws make it illegal for employers to discriminate against an employee or potential employee in certain workplaces. The Equal Employment Opportunity Commission (EEOC), which was created by the Civil Rights Act of 1964, is the federal agency that has the responsibility to promote equal opportunity in employment through administrative and judicial enforcement of the federal civil rights laws and through education and technical assistance. The EEOC handles complaints about workplace discrimination. While state laws may differ, the federal laws prohibit discrimination in employment for: AgeDisabilityNational originPregnancyRaceReligionSex or genderSexual harassment The EEOC has also made decisions about such areas, for example, as: Equal payRetaliation for making a sexual harassment claim Now that you have had the opportunity to understand the components of the Civil Rights Act of 1964, you can use and apply this information in your workplace. A little more control in the job search can only be a good t A little more control in the job search can only be a good t While the possibility of a recruiter or interviewer taking the time to go through the profiles of your connections to find pictures of you, it is conceivable that they might inadvertently see them mentioned while visiting your own profile. And even if the risk is infinitesimally small, does anyone enjoy the feeling that you don't know exactly how much of your life is currently living online? Fortunately, there is the beginning of a solution- at least for those on Facebook. A new application for the social networking site allows users to search for photos of themselves using facial recognition technology. You read that right: the app will scan the internet for you and pull up any and all pictures that may contain your visage, so that you're at least aware enough of them to request that they be taken down. Ohâ¦and it does it for free. Need I say more?Posted by Phil Stott, Vault.com

Why Your Friends Are A Great Resource To Finding Employment
Why Your Friends Are A Great Resource To Finding Employment Why Your Friends Are A Great Resource To Finding Employment Theres nothing quite as painful as unemployment with no prospects. If youre unemployed, you are aware of the toll it can take on you. Whether you were fired or laid off, there can be emotional feelings of rejection and a lack of confidence in your ability to do a good job. There are also those normal feelings of fear and anxiety because employment is the way a person is able to provide for their own well-being and their family. When the cash flow comes to a complete halt, it is time to reevaluate the financial situation and figure out how to make things work. Your first instinct usually involves you trying to figure out how to find a job fast. If you have found yourself in this predicament, please do not go online and read those articles about people who were unemployed for months and months on end. Unemployment doesnt have to be a way of life for you. It is possible to get back on your feet and provide for your needs effectively. It is important to become extremely strategic when youre looking for a job. When its time to begin the job search, many people brush up their resumes and start applying to jobs like crazy. However, one of the best and most underused resources to find employment are the people in your inner circle. Your friends are important through this process for a few reasons. Networking Anyone in the working world will confirm that its not always what you know but who you know. Networking and making connections are vital for success. A popular quote says that no man is an island. This is especially true when that man wants a job. Even though it may be embarrassing at first, dont be afraid to put yourself out there and tell your friends whats going on. You dont necessarily need to tell them how you lost your job if you dont want to. However, whats most important is that you share that youre on the market and youre looking for paid employment. Ask them if they know about anyone who is looking. In addition to asking your personal connections, log on to Facebook. Most people might turn a blind eye if you post a status sharing that you need a job. However, not everyone will. There are people who know of others who are hiring. It doesnt hurt to try. If your Facebook friends list has at least 200 people on it, there are at least five people who will respond with a direct connection that they know of. All you need is one job. Dont be afraid to post a Facebook status. All you need to say is that youre looking for a great job. Let people know that if they have any leads, they should send you a direct message in your inbox and take it from there. Youd be surprised how many people know of leads and are willing to help someone else out, even if its just an acquaintance through Facebook. If youd like to know how to find a job fast, try this effort first. Proofreading Polish âIron sharpens iron,â so does one man do for another. No matter who your friends are, you should be able to learn from them and get a helpful perspective when you need it. The same applies to the job hunt. If you walked out of the bathroom with toilet paper stuck to your shoe or if you were walking around with a booger hanging from your nose, you would want someone who cares to tell you. Many people walk around with hypothetical tissue paper or boogers stuck to their resumes. When youve written your own resume, it can be hard for you to see what improvements should be made in order to get great results. Its also very easy to overlook simple spelling and grammatical errors. While these might be simple errors, they usually stand out to a potential employer and dont look very good. In order to keep your resume from closing the door to your own success, have a few friends look it over. If you have any friends who are good writers and editors, have them look over the resume and make the necessary changes. Sometimes, its not enough to rely on the spell checker in your word processing program or editing software. There are times when another pair of human eyes is helpful to replace weak words with power words and turn a resume into a shining and strong representation of the work you can do and the expertise you can offer to a company. Strengths Finder Good friends are also important because they can help you find yourself. If you really think about it, your thoughts can get in your own way. Unless you have really high self-esteem, it is easy to doubt yourself and your abilities. A good friend will stand in the gap and help you find your strengths and harness them for a great career. Many times, the things were good at are right under our noses. However, because we do them so well, we dont notice the impact that those skills possess. Sometimes it takes someone on the outside to see that particular strength and encourage us to pursue a career that allows or encourages the use of that strength. If you are in a position where youve been fired from a job because you werent good at it, now is a good time to take a look at yourself and do some research. Within that research, reach out to friends and loved ones. Ask them what they think youre good at. Youd be surprised at the answers you might get. After asking multiple people, take a look at the answers that seem to be the same. Use the similar answers as a starting point to find what job will fit those strengths. It might mean that you have to start in a new field. However, when you work in the area that youre strongest in, this is a great way to find employment and keep it for the long haul. â"â"â"â"â"â"â"â"â"â" Author Bio: Paul Langdon is the Job Connection Program Manager. Eight Steps to Make Every New Hire Count
Eight Steps to Make Every New Hire Count Eight Steps to Make Every New Hire Count Eight Steps to Make Every New Hire Count Chinsky Matuson Every new hire counts, especially if you are a small business, but even more so in a down economy. These eight steps will help to accelerate the productivity of your new hires and your hiring process: Clearly define the job description you are staffing prior to starting the hiring process. In good times, employers often skip this step in an effort to get bodies in the door. Yes, they may obtain the headcount needed, but that doesnt necessarily mean they have hired highly productive employees who will stay on board longer than a month. There is nothing more frustrating to a new hire then walking into a job that is either above or below their capabilities. When assessing your needs, take the time to analyze the results you are trying to achieve and include these traits when writing the job description. In doing so, you may find that the level of person you thought you needed is entirely different than what you really need. Keep the bloom on the rose. The courting of candidates should not end the moment they say, I do. Make it a point to let new hires know how excited you are to have them join the team. You can do so by sending their business cards, along with a personal note, to their home. You can also send some company goodies, such as a cap or t-shirt with your logo, so they feel a part of the family before they walk in the door. Prepare for their arrival. Have you ever walked into your new office only to find someone elses name still on the wall? It can be very disconcerting to watch your boss tear off the nameplate and throw it in the trash. Prepare for a new hires arrival so they can quickly assimilate into their new role and be productive on day one. A well-designed onboarding program will ensure you have the right pieces in place to best support your new hire before their arrival as well as during their first 30 to 90 days. This will also help to reduce employee turnover. Hire for fit. You certainly wouldnt select an out of shape quarterback for your team, yet many companies fail to hire for fit for their teams all of the time. Its extremely important to do your due diligence in the employee selection process to ensure that the person is a good fit, states consultant Gail Finger, who works with Federal agencies, non-profits and private sector organizations to improve their human capital strategies and outcomes. Utilizing behavioral interview questions, which are predicated on the premise that the best predictor of future behavior is past behavior, can be one of the best tools available for assessing fit. Skip Weisman, president of Weisman Success Resources also recommends using personality assessments, prior to a final offer being made. Eliminate non-performers immediately. Imagine walking into an organization and finding out that youve got to work twice as hard because there are people in the office who should have been gone a long time ago. Some people in this situation might stay and try to work it out, while most will be out the door the moment they realize they are the only ones working. Clear the dead wood before bringing in fresh people to get better results in how you manage your team. If your new hire turns out to be a hiring mistake,be sure to take the steps to swiftly move ahead. Create an environment of certainty. According to Weisman, In a down economy the primary thing that prevents people from giving more of themselves is uncertainty. An employee who feel uncertain about their job will also feel fear and doubt, which is a significant distraction. These distractions will prevent employees from giving of themselves. So, employers should do whatever they can to give employees as much certainty as possible over their work situation. Weisman says employers can do this by communicating and creating corporate transparency to the highest degree possible. Provide employees with as much control over their situation as you are able to. Dont patronize your employees. You may feel your employees are lucky to have a job in these trying times. Thats fine, but keep your feelings private. Pushing people harder doesnt necessarily translate to having people work harder. Instead, create an environment where employees feel valued and be sure to keep engaging employees. Engage them! exclaims Finger. She goes on to state, The key driver of employee engagement is the connection the employee feels with hisor her leader. Having conversations that lead to a personal connection go a long way towards creating engagement, which is defined as an employees willingness to freely give their discretionary time. Its not about you; its about them. Lisa Martin, who is a Top Talent Consultant and Coach and President of Lisa Martin International, believes that when talented people begin new roles they want to be able to make an impact and positive contribution, regardless of the economy. Discover and appeal to their values and aspirations and provide a project that will stretch them in a direction they wish to pursue, suggests Martin. New hires are an important resource and should be treated that way, especially at a time when every hire counts. By doing so, you will set the stage for a workplace where every employee feels valued in any economy. 2010 Human Resource Solutions. All Rights Reserved. 5 Things to Do Differently at Work This Year
5 Things to Do Differently at Work This Year 5 Things to Do Differently at Work This Year So you had your annual performance review at work, and it didnât go as well as expected. Maybe your boss had a lot of criticism. Or perhaps itâs not that you did anything wrong, per se, but rather, you simply didnât push yourself hard enough to achieve results. No matter your circumstances, if you want 2019 to be the year your career really takes off, here are a few items to add to your must-do list. If you work for a large company, itâs easy to get lost in the shuffle. So if you really want to stand out next year, and thus increase your chances of climbing the corporate ladder, youâll need to show your management team that you have the ability to take the lead on major projects and run with it. As the new year kicks off, youâre likely to see a host of initiatives come to the table. Grab one. And then do it again, and another time after that. Prove that youâre a natural leader, and youâll likely be rewarded for it. Though modesty is a good quality in theory, there comes a point when itâs not such a great idea to downplay your successes at work. Next year, make a point of highlighting your personal wins so that your boss not only takes notice, but also takes them into consideration when deciding whether youâll get promoted. Of course, this isnât to say you should toot your own horn at every possible opportunity. But if, say, you put together a marketing brochure and get great feedback from your sales team, you shouldnât hesitate to tell your boss how much everyone gushed over your work. Whether youâre speaking in front of a couple of people or a much larger crowd, presenting successfully is often a matter of strategy and practice. If your presentations have been average thus far, make 2019 the year you really hone them. Work on making eye contact with your audience, and boost your graphics skills to give the folks youâre speaking to something compelling to look at. Learning how to really nail presentations will give you the edge you need to get ahead. Nobody wants to be that person who balks at an ambitious request. But if you maintain the habit of agreeing to do things and falling short because those requests are unreasonable in nature, youâre only going to end up hurting your career. Next year, pledge to push back when people come to you with impossible demands. If, for example, youâre booked solid for the remainder of the week, and youâre asked to take on another big assignment, be clear about your predicament, and ask to either bow out gracefully, or have something else taken off your plate. Itâs natural to want to come off as the resident superhero, but if you take on too much, you risk letting everyone down - not to mention stressing yourself out to an unhealthy degree. Itâs hard to know what your boss is thinking - and how your performance stacks up - if you hardly ever get a chance to sit down and talk to him or her. Next year, pledge to be more proactive in soliciting manager feedback. Send your boss emails as necessary to gauge his reaction to your work, or ask to set up a recurring one-on-one meeting so that you both have a chance to regularly hash things out. Knowing how your boss feels about you and the work youâre doing will help you get ahead of issues that, if left unaddressed, might hold your career back. We all want to be as successful as possible at work. If 2018 didnât go the way you planned, then itâs time to move on and focus on the future. With any luck, 2019 will be the year you land a promotion, get a nice raise or achieve whatever other goals youâve been working toward. This article was originally published on The Motley Fool . How a Commercial Litigation Attorney Can Help Your Firm
How a Commercial Litigation Attorney Can Help Your Firm How a Commercial Litigation Attorney Can Help Your Firm Litigation is a growing specialty area that's driving law firm revenue and legal hiring. And according to a Robert Half Legal survey, 30 percent of all hiring by law firms and corporate legal departments to support this particular practice area is to fill commercial litigation roles. That's why hiring commercial litigation attorneys and other specialized legal talent is a strategic and necessary move for many law firms facing stiffer competition for commercial business. Hiring professionals with the right combination of in-demand skills allows law offices to assemble lean and more nimble teams that are much more effective at providing quality services to cost-conscious clients for less. Competition for these professionals is increasing, with demand outstripping supply. Corporate legal departments are, of course, among the clientele closely watching the bottom line. Relying less on the services of outside legal counsel is one approach to saving costs. But this decision can create the need to bring the targeted skills and knowledge of commercial litigation experts in-house. If your legal organization is contemplating hiring a commercial litigation attorney, here are three reasons you might want to follow through with it: 1. Protection of business interests Commercial litigation attorneys are focused on protecting business interests. No matter what issue a commercial litigation attorney is asked to provide counsel on - a new contract, a compliance matter, an executive hire, a merger or acquisition, a patent dispute or something else - you will have someone who is devoted to providing timely legal counsel and protecting the interests of the business. Robert Half Legal understands the urgency behind finding A-list professionals for law office projects now. Let us help you find the candidate who is the right fit for your firm - fast. REQUEST TALENT 2. Specialization of focus Commercial litigation attorneys focus on ... well ... commercial litigation - which means you don't have to. Many commercial litigation issues are not routine matters, nor are they the only pressing issues other corporate lawyers on your team need to handle. In fact, commercial litigation can be very disruptive to the business, and a top-of-mind concern for executive management. Having a commercial litigation attorney on staff means you have a go-to person who is prepared to focus on addressing these issues so everyday operations aren't sidelined. 3. Expertise in commercial litigation Commercial litigation attorneys help determine whether litigation is the right course of action. Perhaps most important, a commercial litigation attorney helps the business decide whether it is necessary to pursue a legal matter in court. These professionals can also recommend more cost-effective and expedient strategies for resolving disputes - again, looking out first for the best interests of the company. If you're still unsure about hiring a commercial litigation attorney full time, or believe you only need to engage a commercial litigation specialist for a short period, consider working with a recruiting firm with legal expertise in this practice area. Hiring commercial litigation attorneys on a temporary or contract basis gives you the opportunity to decide whether your organization has an ongoing need for this expertise. It also allows you to confirm before you make a legal job offer whether a candidate has the right skill set and will be a good fit for your work environment. How Your Employer Brand Can Benefit From a Bad Review
How Your Employer Brand Can Benefit From a Bad Review How Your Employer Brand Can Benefit From a Bad Review More than 20 years ago the Internet reinvented job advertising, job searching and employer research. But every technology advance seemingly comes with its dark side. The proliferation of online reviews for just about everything has left many business owners, chefs, product manufacturers, book authors, entertainers and employers with a love/hate relationship with reviews. As individuals they now depend on them for purchase decisions, but as business owners they often dread reading bad reviews, fearful of unfounded complaints and fake reviews from competitors. Bill Tancer, author of the book âEveryoneâs a Critic: Winning Customers in a Review-Driven Worldâ and general manager for global research at Experian Marketing Services, calls business ownersâ reactions to reviews a form of cognitive dissonance. In an interview with Simply Hired, he elaborated on some of the ideas discussed in the book. âThe classic example of cognitive dissonance is a chefâs reaction to a bad review. âHow can that be?â he asks, knowing how much effort went into preparing the food.â The human mind experiences conflict when it considers two observations that both canât be true. Just as a reaction to an entrée is obviously a matter of taste, employers also have fans and detractors. Where one spends at least a third of oneâs day is a big decision, and job seekers increasingly consult reviews before accepting an offer. According to a 2014 survey, nearly 8 in 10 Americans at least sometimes check reviews before purchasing a product or service. While reviews can be difficult for recruiters and HR managers to look at, Tancer writes, âEvery valid negative viewpoint in a review has the potential for helping you improve your business. Think of it not a criticism but as data.â Harnessing the Power of Bad Reviews To help with the cognitive dissonance business owners experience when reading reviews of their businesses, Tancer recommends an âexercise in desensitization,â outlined below. While Tancer is not a business owner himself, he experienced the cognitive dissonance of bad reviews firsthand after the release of his first book, Click: What Millions of People Do Online and Why it Matters. Despite the difficulty of considering the points made in the bad reviews, he said, âI found that there was some truth to the criticism.â One reviewer said that âClickâ was âtoo promotionalâ because he only used one source of data- his employerâs. âI used that information to ask my publisher to get an editor who would be harder on me for this book. I wanted someone who would push me to use different data sources and make sure I didnât get promotional.â Exercise in Desensitization Once you step past the cognitive dissonance, thoughtful evaluation of reviews can help you get a better understanding of your employer brand and decide how to improve it and highlight it. Before doing this exercise for your own company, try doing it for a previous employer. Spend a few minutes putting yourself back on site at that job. Take out a piece of blank paper and draw a line down the middle and label the columns âprosâ and âcons.â Write in the appropriate column everything you remember, from the office environment, your former manager and colleagues, the work you did, the review process, the perks, etc. Now go through the online reviews of the company, sorting by five-star reviews to find material for the âprosâ column and scrolling or sorting to the end to read one-star reviews for the âcons.â Once youâve got your list and the aggregate list from the reviews, look for similarities, differences and things you missed in your own assessment. Are there any patterns to the comments? Any eye openers? âOne of the hidden values of online reviews,â Tancer said, is that âoften the aggregate opinion of online reviewers can reveal perspectives you may have missed.â When you do this for your own company and find the patterns, use this information to decide: Which negative comments can be addressed through HR practices, employee communication or should be communicated to specific department managers? Which positive comments indicate an aspect of working at the company that can be highlighted in employer branding materials or otherwise communicated to candidates? Reviewer Bias is Real But thereâs still a danger in the natural bias of reviewers. âThere are always people with gripes,â Tancer said. âMaybe they got fired or had a bad experience. And then there are the company defenders.â This is common among reviews for many business types. âPeople who are infrequent reviewers tend to give either one star or five stars,â said Tancer. The unique situation for employers is that most people only hold one job at a time and average tenure lasts several years. Infrequency is the nature of employment reviews. Those who review restaurants or products have many more opportunities to write reviews. Are the âBestâ Really the Best for Everyone? Tancer completed the same exercise in desensitization for Freakonomics, a popular book about economics and incentives that he admired. In evaluating the reviews of a runaway bestseller, he was surprised to find it had several hundred 1- and 2-star reviews. The perspective that every author, no matter how popular or acclaimed, had to confront bad reviews made him feel less alone. After doing the desensitization exercise for a current or past employer, Tancer recommends doing the same evaluation of reviews for a best-in-class company (e.g., one on a âbest places to workâ list). âThe more popular something is, the more critical people can become,â he said. âPopularity lends itself to more scrutiny. âIs this really as great as everyone says it is?ââ In âEveryoneâs a Criticâ he describes reading the one-star reviews for a famous California restaurant, The French Laundry. Many of the reviews were about the difficulty of getting a reservation or the high cost, rather than the food itself, though one reviewer wrote, âanybody who could grill a steak or chop carrots could cook this food.â Thereâs just no way to please everyone. âA few bad reviews might be good for you,â Tancer said. A study by Reevoo found that that 68 percent of consumers trust reviews more when they see both good and bad scores. Close to a third suspect fake reviews or censorship when there are no bad reviews. âBad reviews communicate that the fit isnât for everyone,â Tancer said. Employers invest in their brands because they want to find more employees who are a good fit. People looking for a new job have obviously left or want to leave because that company or position is no longer a fit. Perhaps they even have written negative comments about their current or most recent employer. On the whole, Tancer believes that reviews are beneficial because they can be the impetus to improve quality. âNow I keep a list of common criticisms, challenge myself to address them and return to those reviews to come up with ways to keep improving.â Thereâs no reason employers canât do the same.
